Terms and conditions of sale

Version in force on 1 November 2026. These terms and conditions of sale (the “Terms”) govern bookings and stays at the Hostellerie de l'Écu de Bretagne (the “Hotel”), a three-star tourist hotel classified by decision of 22 December 2022, operated by the company below. These Terms are a translation of the French original: in the event of any discrepancy, only the French version is authoritative (article 17.1).

Article 1. Scope and acceptance

1.1 The Terms apply to every booking of a room and of ancillary services made directly with the Hotel: on the website www.ecudebretagne.fr, by telephone, by email or at reception.

1.2 The “Guest” means any person, consumer or business, who books or stays at the Hotel. The Guest declares that they are of full age and have the capacity to contract. A Guest booking for other people guarantees that all occupants will comply with the Terms.

1.3 The Terms are communicated to the Guest before the contract is concluded: they may be consulted at any time on the Hotel's website and at reception, and are attached to the booking confirmation email. The Guest accepts them by validating the booking on the website, or by confirming in writing a booking made by telephone or by email. The applicable version is the one in force on the day of the booking.

1.4 Where the booking is made through an intermediary (booking platform, travel agency, tour operator, gift box), the price, payment and cancellation conditions are those communicated by that intermediary. The house rules in articles 7 to 13 apply for everything else; they appear in the property conditions published by the intermediary and are restated to the Guest on arrival, on the registration form they sign.

1.5 Particular conditions agreed with the Guest (the rate chosen, a group quotation, a corporate contract) prevail over the Terms in the event of conflict.

1.6 Unless stated otherwise, periods expressed in days in the Terms are calendar days.

Article 2. Booking

2.1 To book, the Guest provides their surname and first name, the number of people, whether or not they wish to take breakfast, a telephone number, an email address and a payment card as a guarantee (article 4).

2.2 The Guest states any particular request at the time of booking: a pet, a guaranteed parking space, two separate beds (twin), an extra bed or a cot, a room accessible to people with reduced mobility, connecting rooms, or arrival after reception closes.

2.3 The booking becomes firm when the Hotel sends a written confirmation by email, with the Terms attached. The Guest checks that it is accurate (dates, number of people, room category, rate) and reports any error without delay. If the Guest does not receive this email, they undertake to contact the Hotel's reception to have the booking confirmed and to check that the email address given is correct.

2.4 The room is allocated within the category booked. Preferences as to floor, location or room number are met subject to availability, without guarantee.

2.5 The room is booked for a set number of people. The Hotel may refuse access to any person exceeding the capacity of the room.

2.6 Groups. Any booking of more than five rooms is a group booking. It is the subject of a quotation, to which the Terms are annexed. It is confirmed only once the following three conditions are met: the quotation and the Terms have been signed and returned to the Hotel; the deposit of 30% of the total amount of the quotation has been paid within fourteen days of the quotation being sent; any documents requested by the Hotel have been provided on time. Failing this, the Hotel may decline to confirm the booking and put the rooms back on sale without notice.

2.7 List of participants. The Guest provides the Hotel with the final list of rooms, in writing, at least twenty days before the arrival date. The detailed list (names, arrival and departure dates and times) is sent by email to contact@ecudebretagne.fr. Every room on that list is guaranteed by the Guest, including in the event of a no-show or late cancellation. The Hotel will endeavour to accommodate additional participants notified later, without being able to guarantee it.

2.8 Individual bookings against an allocation. Where participants book their own room from those held for the group, rooms not booked are put back on sale twenty days before the arrival date. They are held if the Guest guarantees payment for the nights not used.

2.9 Last-minute changes. Any change concerning the group's arrival (arrival or departure time, the name of a participant) is notified by email to contact@ecudebretagne.fr. No verbal agreement is taken into account.

2.10 The Hotel may refuse or cancel a group booking where the planned event is incompatible with the peace of other guests or with the normal running of the property, or where it endangers the safety of people and property. Any sums paid are then refunded.

Article 3. Prices and tourist tax

3.1 Prices are expressed in euros, all taxes included, per room and per night, for the number of people and the dates indicated.

3.2 The applicable price is the one given to the Guest at the time of booking and repeated in the confirmation. Prices vary according to the dates, the room category, the rate chosen and the occupancy of the property. They are displayed at reception, in the rooms and outside the property. Prices offered by online booking platforms may differ from the Hotel's. Any discounts and promotions applied there are decided by those platforms, independently of the Hotel. Everyone remains free to book through the channel of their choice.

3.3 The tourist tax is not included in the price. It amounts to €1.10 per person per night from the age of 18, including the additional departmental tax. Its amount is set by the Communauté de communes des Terres du Val de Loire and by the Département du Loiret; it may change, the amount due being the one in force on the date of the stay.

3.4 Unless stated otherwise on the confirmation, breakfast and the services below are not included in the room price. Rates in force at the date of this version:

3.5 Included in the room price: Wi-Fi, access to the pool during its opening season, parking in the courtyard subject to available spaces (first come, first served, on the conditions of article 11) and the bicycle room.

Article 4. Card guarantee and payment

4.1 Every booking is guaranteed by a valid payment card, of which the Guest provides the number and expiry date. The Hotel may check its validity by a pre-authorisation request, which is not a charge.

4.2 On the Flexible rate, no prepayment is required: the stay is paid for on site. On the Non-refundable rate, the full amount of the stay is charged at the time of booking.

4.3 The stay is paid for on site, on the Guest's arrival. The Hotel accepts Visa, Mastercard and American Express cards, as well as chèques-vacances, in paper or Connect form. Cash is accepted for any payment, within the ceilings set by article D. 112-3 of the French Monetary and Financial Code; it is then for the Guest to tender the exact amount (article L. 112-5 of the same code). Where the stay is paid for other than by card, a card imprint is taken as a guarantee. Services consumed during the stay are paid for as they are consumed.

4.4 Guarantee at the time of booking. The Guest authorises the Hotel to charge the card given at the time of booking with the amount due in the event of late cancellation or no-show on the Flexible rate (article 5). That amount, equal to the price of the first night booked, appears on the confirmation.

4.5 Guarantee during the stay. On arrival, the Guest signs the registration form, which restates the house rules and includes an authorisation to charge. The Hotel places a pre-authorisation of €150 on the Guest's card; this is not a charge. That authorisation secures the sums due under the Terms: unpaid services, charges arising from breach of the smoking ban (article 8) and the cost of damage (article 10).

4.6 Sums identified after departure. The Hotel sends the Guest an invoice by email stating the amount and the reason, with supporting evidence. The Guest has seven days from that email to make representations, to which the Hotel replies before any charge is made. The Hotel charges the card only once that period has expired and up to the €150 authorised on the registration form. Above that amount, the Guest settles the invoice by the means of payment of their choice, within fifteen days of receiving it.

4.7 The stay is invoiced on the Guest's arrival, at the time of payment. The invoice is handed to them at reception and sent by email.

4.8 Guests whose employer has entered into a contract with the Hotel benefit from the corporate rate provided for in that contract. Depending on the company and the contract, the invoice may be issued directly in the company's name, for payment by bank transfer within thirty days of the invoice date. In the absence of such an agreement, the stay is paid for on site on the conditions of article 4.3. Any late payment by the company gives rise to penalties calculated at three times the French statutory interest rate, together with a fixed recovery charge of €40 (article L. 441-10 of the French Commercial Code).

4.9 Groups. A deposit of 30% of the total amount of the quotation is paid at the time of booking. The balance is settled no later than the day of arrival, unless the quotation states otherwise. If the deposit is not paid, the Hotel may cancel the booking without compensation to the Guest. Any late payment gives rise, for a consumer Guest, to interest at the statutory rate from the date of formal notice; for a business Guest, to the penalties and charge provided for in article 4.8. Additional services supplied at the Guest's request (drinks, catering, other services) are invoiced to them, unless it has been agreed that participants settle their own expenses.

Article 5. Cancellation, amendment and no-show

5.1 Any request to cancel or amend is sent to the Hotel by email, or by telephone followed by written confirmation from the Hotel. It takes effect on the date the Hotel receives it.

5.2 Flexible rate. The Guest may cancel free of charge until 12.00 noon, two days before the arrival date. Example: for an arrival on Saturday, cancellation is free until Thursday at noon. After that, the price of the first night booked is payable and the rest of the booking is cancelled free of charge, except in the case provided for in article 5.5.

5.3 Non-refundable rate. The booking cannot be cancelled, amended or refunded. The amount charged at the time of booking is retained by the Hotel, subject to articles 14.1 and 14.2.

5.4 No-show. A Guest who has not arrived by the time reception closes on the expected day, without having agreed a late arrival, is treated as a no-show. On the Flexible rate, the price of the first night booked is payable and the rest of the booking is cancelled. The Hotel is then free to dispose of the room.

5.5 Exception. On the Flexible rate only, no sum is payable where the late cancellation or no-show results from the hospitalisation or death of the Guest, of an occupant of the room or of a member of their close family (spouse or partner, parent or grandparent, child or grandchild, brother or sister). The Guest sends the Hotel dated supporting evidence within fifteen days of the expected arrival date. This exception applies neither to the Non-refundable rate nor to group bookings.

5.6 Early departure. Nights taken are payable. On the Flexible rate, a Guest who shortens their stay without having told reception by noon the previous day owes the night following their departure. On the Non-refundable rate, no refund is made.

5.7 Amendment. On the Flexible rate, any amendment requested within the period in article 5.2 is accepted subject to availability and at the prices in force for the new dates.

5.8 Groups. Any cancellation or amendment of a group booking is notified in writing, by post or by email with acknowledgement of receipt. If the Guest cancels, the following sums are payable to the Hotel:

In the event of early departure or no-show, the whole of the stay booked is invoiced, less any nights the Hotel has been able to re-let. If the Hotel cancels the group booking for a reason attributable to it, article 14.1 applies.

5.9 Sums paid in advance do not constitute arrhes within the meaning of article L. 214-1 of the French Consumer Code. The consequences of a cancellation are exclusively those provided for in this article and in article 14.

5.10 The Guest is invited to take out cancellation insurance with the insurer of their choice.

Article 6. No right of withdrawal

The Guest does not benefit from the fourteen-day withdrawal period provided for distance contracts. Article L. 221-28, 12° of the French Consumer Code excludes that right for accommodation services supplied on a specified date or for a specified period. Only the cancellation conditions in article 5 apply.

Article 7. Arrival, departure and house rules

7.1 Arrival. Rooms are available from 3pm. An early arrival, from 1pm at the earliest, is possible with reception's prior agreement, subject to availability, at the rate in article 3.4. Reception is open from 6am to 11pm on weekdays and from 6.30am to 11pm on Saturdays and Sundays. Arrival after 11pm is possible only if it has been agreed in advance with reception, the Guest having given their arrival time.

7.2 Departure. The room is vacated and the key returned before 11am. A later departure, by 1pm at the latest, is possible with reception's prior agreement, subject to availability, at the rate in article 3.4. Without such agreement, occupying the room beyond 11am may give rise to an additional night being charged.

7.3 Formalities. On arrival the Guest presents valid identification: a national identity card or a passport. They sign the registration form provided for in article 4.5. For guests of foreign nationality, an individual police record is drawn up in accordance with article R. 814-1 of the French Code on the entry and residence of foreign nationals and the right of asylum. The Hotel may complete it from the passport presented; the Guest signs it. The Hotel may refuse access to the room to a Guest who does not comply.

7.4 Minors. People under 18 stay accompanied by an adult who is responsible for them.

7.5 Occupants and visitors. Only registered people occupy the room. Visitors report to reception and do not spend the night on the premises without having been registered.

7.6 Use of the premises. The Guest uses the room and the common areas peaceably and respects the quiet of other guests, particularly at night. For fire safety reasons, cooking appliances and portable heaters may not be used in the rooms. Toxic, health-hazardous or flammable products are prohibited on the premises. In an emergency, the person in charge of a group assists in evacuating the participants.

7.7 Access to the room. Hotel staff may enter the room for housekeeping, maintenance or safety reasons.

7.8 Breach. In the event of a serious or repeated breach of the Terms, the Hotel may end the stay, after a warning has gone unheeded, or immediately if there is a danger to people or property. Nights taken and charges remain payable; nights not taken through the Guest's own doing are not refunded.

7.9 Accessibility. Two rooms are adapted for people with reduced mobility, on request at the time of booking: a Standard room on the ground floor, overlooking the courtyard, and a Superior room overlooking the square, reached by lift. The public accessibility register may be consulted at reception.

Article 8. Non-smoking property

8.1 The Hotel is entirely non-smoking. Smoking is strictly prohibited in the rooms and in the indoor areas of the property. This prohibition applies including at the window or with the window open, and covers electronic cigarettes.

8.2 In the common areas, this prohibition also follows from the law (article R. 3512-2 of the French Public Health Code). In the rooms, it is a matter of the condition of the premises: tobacco smell impregnates fabrics, bedding and coverings durably. The room must then be treated and cannot be re-let immediately.

8.3 Where this prohibition is not complied with, charges for cleaning, deodorising and restoring the room may be invoiced to the Guest. These charges are set at €150 per room, without prejudice to the invoicing of any additional damage found.

8.4 The breach is recorded by Hotel staff: tobacco smell, cigarette ends, ash, burns or the triggering of a smoke detector. The record is dated and, so far as possible, accompanied by photographs. The Guest is informed of it. The charges are added to their invoice or settled on the conditions of articles 4.5 and 4.6.

8.5 Disabling, covering or dismantling smoke detectors is prohibited. Costs arising from the fire alarm being set off through the Guest's own doing remain payable by them.

8.6 Burns and other damage caused by tobacco are invoiced in addition to the fixed charge, on the conditions of article 10.

8.7 Guests who wish to smoke do so exclusively in the courtyard or outside the property. In the courtyard, planters set aside for the purpose, ashtrays and bins are available to them. Smoking is prohibited in the garden and around the pool.

Article 9. Pets

9.1 Domestic animals are accepted: dogs, cats and other pets. The Guest declares their animal at the time of booking. Category 1 dogs (attack dogs) are not admitted, their access to premises open to the public being prohibited by article L. 211-16 of the French Rural and Maritime Fishing Code. Category 2 dogs (guard and defence dogs) are admitted, muzzled and kept on a lead in the common areas; their owner presents the ownership permit on arrival.

9.2 The supplement is €15 per animal per stay, whatever its length, paid on site. It remains payable where the animal has not been declared. Guide dogs and assistance dogs accompanying a person with a disability are welcomed without supplement.

9.3 The animal stays in its owner's room. It is also admitted in the breakfast room and in the property's bar, Le Comptoir de l'Écu. It has access to the garden and to the area around the pool during the pool's opening season. It may not swim in the pool.

9.4 The animal remains at all times in the Guest's keeping and under their responsibility. It is kept on a lead or carried in the common areas. The Guest brings its bedding and bowls, picks up its droppings and ensures that it does not disturb the quiet of other guests.

9.5 An animal left alone in the room is left there under the Guest's sole responsibility, and the Guest informs reception. Housekeeping may not be carried out where an animal is alone in the room. In the event of a nuisance, the Hotel contacts the Guest, who returns without delay.

9.6 The Guest is liable for damage and soiling caused by their animal on the conditions of article 10.

Article 10. Damage and restoration

10.1 The room, its furniture, its linen and its equipment are made available to the Guest in good condition. The Guest reports to reception, on arrival, anything they find to be wrong. They use the premises reasonably and return them in the condition in which they found them.

10.2 The Guest is liable for any damage, breakage, disappearance or abnormal soiling caused during their stay to the room, to its contents or to the Hotel's common areas. That liability covers their own acts, those of the people accompanying them or whom they receive, and those of the animal in their keeping (article 1243 of the French Civil Code).

10.3 This covers in particular:

  • furniture, bedding, linen, floor coverings and walls;
  • equipment: television, air conditioning, safe, kettle, coffee machine, bathroom fittings;
  • stains, burns, scratches, bites, urine marks and hair requiring specific cleaning or replacement;
  • missing items: bed linen, towels, pool towels, keys.

10.4 Record. Damage is recorded by Hotel staff during the stay or when the room is checked after departure. The record is dated and accompanied by photographs. The Hotel informs the Guest of it by email as soon as possible, with a description of the damage, the photographs and the amount claimed.

10.5 Amount. Everyday items missing or damaged are invoiced according to the price schedule in the annex. For other damage, the Guest bears the actual cost of restoration or replacement, on supporting evidence (invoice, quotation or replacement value), including labour and specific cleaning. If the room cannot be re-let while the work is carried out, they also bear the nights lost, at the room price, for the period strictly necessary.

10.6 Settlement. The sums due are added to the Guest's invoice if they are still on the premises. After their departure, they are settled on the conditions of article 4.6.

10.7 The Hotel retains the right to claim compensation for its entire loss, including from the Guest's public liability insurer.

Article 11. Parking and bicycles

11.1 The Hotel has a private, gated courtyard reserved exclusively for its guests. It is reached through an archway 2.50 m wide and 3 m high. The Guest checks that their vehicle can pass through it.

11.2 Parking in the courtyard is free, subject to available spaces: the courtyard has fewer spaces than the Hotel has rooms. Spaces are allocated on a first come, first served basis, without reservation or guarantee. A Guest who wants an assured space books it in advance, at the rate in article 3.4.

11.3 The gate is closed from 11pm to 6am on weekdays, and until 6.30am at weekends and on public holidays. It may close earlier; reception then informs the Guest on arrival. No vehicle enters or leaves while it is closed. Guests come and go freely on foot at any hour.

11.4 The Hotel's liability in respect of vehicles parked in the courtyard and of the items they contain applies on the conditions and within the limits of articles 1952 to 1954 of the French Civil Code. The Guest locks their vehicle and leaves no valuables visible in it. They are liable for damage they cause to other vehicles and to the premises.

11.5 Bicycles are stored in a lockable room, made available to guests free of charge.

Article 12. Pool and garden

12.1 The heated outdoor pool is reserved for Hotel guests. It is open from 1 June to 30 September, from 8.30am to 9.30pm.

12.2 There is no lifeguard. Children remain under the constant supervision and responsibility of the adults accompanying them.

12.3 Pool towels are given to the Guest on arrival, at no extra charge, and returned to reception. Swimwear and other swimming items (sun products, accessories) remain the Guest's responsibility. Room towels are not used at the pool.

12.4 The Hotel may close the pool temporarily for weather, technical, hygiene or safety reasons. A closure imposed by weather conditions or by a hygiene or safety requirement does not give rise to any right to compensation.

Article 13. The Hotel's liability and personal belongings

13.1 The Hotel is liable for clothing, luggage and items brought in by the Guest on the conditions and within the limits of articles 1952 to 1954 of the French Civil Code. Every room has a safe, which the Guest is invited to use for valuables.

13.2 The Hotel is not liable for theft or damage resulting from force majeure, from the nature or a defect of the item, or from the Guest's own fault, in particular where the door or windows of the room have been left open in their absence.

13.3 Items left behind are kept for one year. They are returned to the Guest at their request and at their expense.

13.4 Wi-Fi is made available to guests free of charge. The Hotel endeavours to keep it running, without guaranteeing a given speed. The Guest uses it in compliance with the law.

13.5 The photographs and descriptions on the website give a faithful impression of the rooms. The floor areas stated are minimums for each category; the layout may vary from one room to another.

Article 14. Relocation and force majeure

14.1 If the Hotel cannot make the room booked available to the Guest, it offers them accommodation of an equivalent or higher category in a nearby property. Any additional cost and reasonable transfer costs are borne by the Hotel. If the Guest refuses that solution, or if no relocation is possible, the sums paid for the nights not provided are refunded to them. Where the Hotel is responsible for the impediment, it also pays the Guest compensation equal to the amount the Guest would have owed on a late cancellation on the same date.

14.2 The Hotel is not liable for failure to perform its obligations where that results from force majeure within the meaning of article 1218 of the French Civil Code, in particular a fire, a flood or an administrative closure. If the Hotel is definitively prevented from providing the accommodation, the booking is cancelled and the sums paid for services not provided are refunded, whatever the rate chosen.

14.3 An impediment personal to the Guest (a strike or transport delay, bad weather, a work or family reason) does not entitle them to free cancellation or to a refund of their stay. Only the cancellation conditions in article 5 apply, with the exception provided for in article 5.5 for the Flexible rate. On the Non-refundable rate, the sums paid are retained by the Hotel.

Article 15. Personal data

15.1 S.N.E.B., identified at the head of these Terms, is the controller of the personal data collected at the time of booking and during the stay. That data is processed in accordance with Regulation (EU) 2016/679 and French law no. 78-17 of 6 January 1978 as amended.

15.2 The data is intended for the Hotel's authorised staff and for its technical providers (property management software, booking engine, payment provider), within the limits of their remit. It is neither sold nor transferred for marketing purposes. It is disclosed to the authorities where the law so requires. Video protection footage is viewed only by the Hotel's authorised staff and, on formal request, by law enforcement. An information sign is posted at the entrance to each filmed area: the archway, reception and the bar.

15.3 The Guest has the right of access, rectification, erasure, restriction, objection and portability. They exercise it by email to contact@ecudebretagne.fr or by post to the Hotel's address. They may lodge a complaint with the CNIL, the French data protection authority (www.cnil.fr).

15.4 A Guest whose telephone number is collected may register free of charge on the Bloctel telephone marketing opt-out list (www.bloctel.gouv.fr), in accordance with article L. 223-2 of the French Consumer Code.

Article 16. Complaints and mediation

16.1 The Guest reports any difficulty to reception during their stay, so that the Hotel can put it right. Any complaint is then sent in writing to contact@ecudebretagne.fr or to Hostellerie de l'Écu de Bretagne, 5 rue de la Maille d'Or, 45190 Beaugency, France.

16.2 In accordance with articles L. 612-1 and L. 616-1 of the French Consumer Code, a consumer Guest may use a consumer mediator free of charge. The Hotel has appointed:

16.3 The mediator may be contacted where the written complaint sent to the Hotel has gone without a satisfactory reply for sixty days, and no later than one year after that complaint. How to refer a matter to the mediator is set out on the mediator's website.

Article 17. Governing law and miscellaneous provisions

17.1 The Terms are governed by French law. They are drawn up in French; in the event of translation, only the French version is authoritative.

17.2 Failing an amicable settlement, a dispute with a consumer Guest is brought before the court having jurisdiction under the applicable rules, the consumer being entitled in particular to bring proceedings before the court of their place of residence. Where the Guest is a trader, any dispute falls within the exclusive jurisdiction of the Commercial Court of Orléans.

17.3 If a provision of the Terms is declared void or deemed unwritten, the other provisions remain applicable.

17.4 The fact that the Hotel does not rely on a provision at a given time does not amount to a waiver of its right to rely on it later.

17.5 The Hotel may amend the Terms at any time. The version applicable to a stay remains the one in force on the day it was booked.

Annex. Price schedule for missing or damaged items

This schedule applies to everyday items missing or damaged when the Guest departs (article 10.5). Prices are inclusive of all taxes, per unit, and correspond to the replacement value at the date of this version.
